Terms of Service for StreetTycoon
Effective Date: September 30, 2025

This Terms of Service agreement ("Terms") constitutes a legally binding contract between you ("User," "you," or "your") and Lan Prijatelj s.p. ("we," "us," or "our") concerning your access to and use of the web-based game "StreetTycoon" (the "Game") and the related website streettycoon.io (the "Site").

By creating an account, or by accessing or using the Game, you agree that you have read, understood, and accept to be bound by these Terms. If you do not agree to these Terms, you must not use the Game or the Site.

1. Your Agreement to These Terms
Your use of the Game is also governed by our Privacy Policy, which is incorporated herein by reference. Please review the Privacy Policy carefully at https://streettycoon.io/privacy-policy.txt to understand how we collect and use your information.
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Game and supersede all prior agreements.

2. Eligibility and User Accounts
2.1. Age Requirement: You must be at least 13 years old to create an account and use the Game (or 16 in certain jurisdictions in the European Economic Area). If you are between the age of 13 and 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2.2. Account Creation: You must provide accurate and complete information when creating your user account ("Account"). You are solely responsible for all activities that occur under your Account.
2.3. Account Security: You are responsible for maintaining the confidentiality of your Account password. You must notify us immediately of any unauthorized use of your Account or any other breach of security. We are not liable for any loss that you may incur as a result of someone else using your password or Account, either with or without your knowledge.

3. License to Use the Game
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Game for your own personal, non-commercial entertainment purposes.

4. Code of Conduct
When using the Game, you agree not to:
a) Violate any applicable law or regulation.
b) Use any cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Game experience.
c) Harass, threaten, bully, embarrass, or do anything else to another player that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.
d) Post or share any content that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive.
e) Impersonate any person or entity, including any of our employees.
f) Attempt to gain unauthorized access to the Game, other players' Accounts, or computer systems connected to the Game.
g) Sell, buy, trade, or otherwise transfer your Account or any personal access to the Game.

A breach of this Code of Conduct may result in the suspension or termination of your Account.

5. Virtual Content and Payments
The Game contains two types of virtual content: "Virtual Currencies" and "Virtual Goods."

5.1. Virtual Currencies
The Game features two virtual currencies: "$" (in-game Cash) and "Gold" (collectively, "Virtual Currencies").
How to Obtain: Virtual Currencies can only be earned through gameplay and achievements within the Game. They cannot be purchased with real money.
No Monetary Value: Virtual Currencies are a limited license for your personal use in the Game. They have no value in real money and cannot be sold, traded, transferred, or redeemed for cash.

5.2. Purchased Virtual Goods
We may offer certain cosmetic skins, perks, or other digital items for purchase with real money ("Purchased Virtual Goods").
Purchases: All purchases of Virtual Goods are processed through our authorized third-party payment processors. You must abide by their terms and conditions. All prices are inclusive of applicable taxes as required by law.
License: When you purchase a Virtual Good, you are obtaining a limited, non-transferable, revocable license to use that item within the Game. You have no ownership or property interest in any Purchased Virtual Goods.

5.3. Payments and EU Right of Withdrawal / Refund Policy
All sales are final. We do not offer refunds except in very limited circumstances, as required by law.
For Users residing in the European Union, you are subject to Directive 2011/83/EU on consumer rights. Please be aware of the following:
Loss of Right of Withdrawal: When you purchase a Purchased Virtual Good from us, you are requesting its immediate delivery and performance. You explicitly acknowledge and consent that by completing the purchase, the digital content is made available to you immediately, and you thereby lose your statutory 14-day right of withdrawal.

Exceptional Refunds: Notwithstanding the above, if a Purchased Virtual Good is defective or does not function as described due to a fault on our part, you may be entitled to a replacement or, at our sole discretion, a refund. To request a refund, you must contact us at lan.prijatelj@gmail.com within a reasonable time, providing details of the purchase and the issue. We will review requests on a case-by-case basis.

6. Intellectual Property
All rights, title, and interest in and to the Game (including all content, code, graphics, and the "StreetTycoon" trademark) are and will remain the exclusive property of Lan Prijatelj s.p. and its licensors. The Game is protected by copyright, trademark, and other laws of Slovenia and foreign countries. Except for the limited license granted in Section 3, these Terms do not grant you any rights to use our intellectual property.

7. Termination
7.1. Termination by You: You may terminate your Account at any time by contacting us or using any in-game functionality for account deletion.
7.2. Termination by Us: We reserve the right to suspend or terminate your Account and access to the Game, at our sole discretion, if you breach these Terms or for any activity that we deem to be disruptive to the Game or harmful to other users.
7.3. Effect of Termination: Upon termination, your license to use the Game will be revoked. You will lose access to your Account, and you will not be entitled to any compensation for any Gold or Virtual Items associated with your Account.

8. Disclaimer of Warranties
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAN PRIJATELJ S.P., ITS AFFILIATES, DIRECTORS, OR EMPLOYEES, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME.

10. Updates and Modifications
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Site or through other communications. Your continued use of the Game after such changes constitutes your acceptance of the new Terms. We also reserve the right to modify, suspend, or discontinue the Game at any time.

11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ljubljana, Slovenia.

For consumers residing in the EU, you may also be entitled to refer a dispute to the European Commission's Online Dispute Resolution (ODR) platform. You can access the ODR platform here: https://ec.europa.eu/consumers/odr.
